Private Prosecutions Ireland
Private Prosecutions Ireland (PPI) was founded on a steadfast belief in accountability, fairness, and the
rule of law. At its core is a commitment to uphold and defend the fundamental
rights enshrined in the Constitution of Ireland—rights that are not mere
ideals but solemn promises designed to ensure equality, dignity, and justice
for every individual.
Accomplishments in 2024
1.
Advancing Access to Justice Through Free Personal Liberty Actions
In October 2024, PPI achieved a
groundbreaking High Court decision affirming that Article 40.4.1°
actions—protecting personal liberty—are exempt from stamp fees. This victory
removes financial barriers for citizens challenging violations of personal
liberty, even outside physical detention, in the Superior Courts. By expanding
access to justice, this milestone reinforces the inviolability of
constitutional rights.
2.
Establishing a Framework for Jury Trials in Public Misconduct Cases
Utilizing Articles 34.1 and 38.5 of the
Constitution, PPI developed a pioneering framework enabling jury trials
to address malfeasance in public office by state employees. This ensures
accountability for serious statutory violations of a quasi-criminal nature. By
emphasizing the critical role of juries, this initiative enhances public
confidence, impartiality, and justice in cases that deeply impact the public
interest.
3. Guiding Private Prosecutions Against Corrupt State Employees
PPI has spearheaded a comprehensive approach
to initiating criminal and civil actions against state employees involved in
corruption. Leveraging Peace Commissioners and Justices to issue summonses, PPI supports victims in pursuing justice and civil remedies
in the High Court, ensuring integrity in public administration and
access to justice for all.
Our
Constitutional Foundation
The work of Private Prosecutions Ireland is
firmly rooted in the Constitution of Ireland, which guarantees that all
citizens are equal before the law. Article 40 underpins our commitment
to safeguarding personal rights, including the right to life, liberty, a good
name, and property.
- Articles 40.3.1° and 40.3.2°:
Obligate the State to protect individuals from unjust attacks and provide
remedies in cases of injustice.
- Article 40.4.1°:
Recognizes the inviolability of personal liberty, empowering citizens to
challenge unlawful actions through the courts.
PPI exists to provide pathways for individuals
to exercise these rights, particularly when public bodies fail to fulfill their
constitutional obligations.
Article 40: The Cornerstone of Justice and Equality
Article 40 of the Irish Constitution embodies the fundamental principles of equality, liberty, and justice. It affirms that all citizens are equal before the law, that personal rights must be protected, and that personal liberty is inviolable. It enshrines the freedoms of expression and assembly as essential pillars of democracy, safeguarding the rights of individuals to live with dignity and autonomy.
These constitutional guarantees are not merely ideals—they are actionable rights, empowering citizens to stand against injustice and demand accountability. Private Prosecutions Ireland is committed to ensuring these principles remain strong and accessible for all, reaffirming that justice and equality are the foundation of a fair and democratic society.is inspired by the Constitution’s guarantees, which underpin the rights of all citizens:
Protection of Families and Children:
Through Articles 41, 42, and 42A, the Constitution recognizes the family as the foundation of society and emphasizes the inalienable rights of parents to provide for their children’s education and welfare. Article 42A further highlights the best interests of children as paramount in all matters. PPI prioritizes safeguarding these rights, holding public officials accountable for actions that harm families or fail to uphold the Constitution’s protections.
By integrating these constitutional guarantees
into its mission, PPI ensures that equality, liberty, and justice are
more than principles—they are actionable commitments to every citizen.
Why Private
Prosecutions Ireland Matters
While the Constitution guarantees fundamental
rights, many citizens find these promises obstructed by bureaucratic systems
and institutional inertia. For victims of misconduct, justice often feels out
of reach. Private Prosecutions Ireland was created to bridge this gap,
ensuring that constitutional rights are not just theoretical but actively
upheld.
- Empowering Citizens: By
providing resources and guidance, PPI equips individuals to take control
of their legal rights and challenge violations independently.
- Restoring Faith in the Rule of Law: By holding public officials accountable, PPI reinforces the
principle that no one is above the law.
- Promoting Transparency and Fairness: Our work reflects the values that form the backbone of Ireland’s
democracy.
