Facilitating Access to Justice: Upholding Ireland’s Constitutional Promise
Promoting access to justice safeguards fairness, accountability, and the enduring principles of Ireland’s Constitution. The rights enshrined in our foundational document—equality, dignity, and justice—are not abstract ideals but actionable promises for every individual. My mission is to empower citizens to claim these rights, ensuring Ireland’s justice system serves all equitably.

2024 Achievements: Advancing Equity

1. Expanding Access to Justice
In October 2024, I secured a landmark High Court ruling exempting Article 40.4 cases—which protect personal liberty—from stamp duty fees69. This critical decision removes financial barriers, empowering individuals to challenge rights violations in the Superior Courts and reinforcing the Constitution’s guarantee of liberty.

2. Strengthening Accountability
Drawing on Articles 34.1 and 38.5, I developed a transparent framework for jury trials addressing public official misconduct. This initiative fortifies impartiality in adjudicating serious violations, rebuilding public trust in judicial processes13.

3. Empowering Citizens
I guided individuals in pursuing legal remedies through accessible mechanisms, including Peace Commissioners and Justices of the Peace for summons issuance. By simplifying pathways for civil and criminal actions, I foster a culture where accountability is attainable for all47.

Constitutional Foundations

Access to justice is rooted in Ireland’s Constitution, which enshrines equality and fundamental rights:

  • Article 40: Guarantees equality before the law, safeguarding personal liberty, reputation, and property. It empowers citizens to challenge injustices and seek redress57.

  • Articles 40.3.1° and 40.3.2°: Obligate the State to defend against injustice and ensure fair recourse7.

  • Article 40.4.1°: Upholds personal liberty as a democratic cornerstone, enabling citizens to hold authorities accountable7.

  • Articles 41, 42, and 42A: Protect families and prioritize children’s welfare, ensuring public actions align with these principles7.

Why This Work Matters

While the Constitution provides robust protections, systemic barriers often render these rights inaccessible. Facilitating Access to Justice bridges this gap by:
